01Operator & scope

OnionPay is the website brand of the operator identified in “Operator details & contact” below. “We”, “us” and “our” refer to that operator; “you” refers to the visitor or person submitting an enquiry. These terms govern use of the website and our handling of consultation requests.

The website introduces acquiring, payouts, card products and money services. Browsing, submitting a form or receiving a request reference does not open an account, approve onboarding, reserve an exchange rate or instruct a payment. A financial service requires acceptance by the relevant contracting provider under its separate agreement.

02Permitted use & authority

You may access public content and make lawful enquiries. You must have legal capacity to submit a request and, when acting for an organisation, authority to represent it. Provide accurate information, keep contact details current and comply with the Acceptable use policy. You are responsible for ensuring that information you supply about others may lawfully be shared for the stated purpose.

Submission of the consultation form signifies agreement to these website terms. The separate contact permission in that form is limited to responding to your request; it is not marketing consent or acceptance of a financial-service contract.

03Consultations, quotes & information

The form records your enquiry and any preferred meeting date. A meeting is confirmed separately. We may seek clarification, decline an enquiry outside our scope or refer you to an appropriate provider. No referral authorises us to share your full enquiry with a separate provider without an appropriate explanation and any permission required by law.

Website descriptions are not binding transaction offers. Supported markets, methods, fees, exchange terms, settlement, limits and service levels depend on the arrangement actually offered and accepted. Illustrations and simulated checkouts do not represent live payments or guaranteed results. Information is general and is not personalised legal, tax or investment advice.

04Provider arrangements & document priority

AutoCard, iSeekMoney and other linked destinations may use separate application processes, operators, issuers, banks or payment partners. Confirm the contracting entity and the documents that govern your chosen service. An MSO disclosure concerns the named holder and stated activities; it does not establish authority to provide every product in every jurisdiction.

Mandatory law takes priority. An accepted product agreement governs the actual financial service, including its own document hierarchy and dispute provisions. These website terms do not amend that agreement, displace statutory rights or release us from responsibility for our own conduct. The Privacy policy explains personal-data handling and is not a waiver of privacy rights.

05Intellectual property & links

You may view public pages and share their links for legitimate informational purposes. Brand names, content and third-party materials remain subject to their respective rights. Do not reproduce substantial content commercially, misrepresent affiliation or remove required attribution without permission. Open-source materials remain governed by their applicable licences.

External links are provided for relevant information or services. We do not control every external site or its changes. A link alone does not constitute endorsement, agency or a guarantee. This does not exclude any responsibility imposed on us by an actual relationship or applicable law.

06Availability, restrictions & changes

We may maintain, correct or update the website and restrict access where reasonably necessary for security, unlawful use, legal requirements or material breaches of these terms. Where lawful and practicable, we will explain a restriction and consider a request for review. A website restriction does not itself determine ownership of funds or terminate a separate service contract.

Revised terms carry an updated date and apply prospectively. Material changes will be highlighted on the website or communicated directly where appropriate. An update cannot retrospectively remove accrued rights or change an accepted transaction without the agreement or legal authority required for that change.

07Responsibility & protected rights

We exercise reasonable care in operating the website and presenting information, but do not promise uninterrupted access or that every description suits a particular transaction. Responsibility for loss is determined by applicable law, including causation, foreseeability and any duty to mitigate. No blanket exclusion or financial cap on our liability is created by these website terms.

Nothing excludes or restricts liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or restricted. Mandatory consumer protections and statutory remedies remain available. Rights relating to an actual payment are also governed by the applicable service agreement and mandatory law.

08Complaints & notices

Send business enquiries to the business contact below. Send website complaints, contractual correspondence and other legal notices to the complaints contact; use the privacy or security contact for those matters. Include the relevant page or request reference and the outcome sought. We will assess the issue and respond through an appropriate channel; this does not promise a fixed resolution time.

Contacting us is not a precondition to urgent legal relief, a regulator complaint or a statutory claim. Sending an email does not establish valid service of court proceedings where procedural law requires a different method, and these terms do not amount to consent to such service.

09Governing law, language & general provisions

These website terms and non-contractual disputes arising from them are governed by Hong Kong law. Hong Kong courts have non-exclusive jurisdiction. This choice does not remove mandatory protections or rights to use a competent court available under applicable consumer or other mandatory law. A product agreement may provide a different lawful dispute arrangement for that service.

The English and Chinese versions are intended to express the same terms. If they differ, the English version prevails to the extent permitted by mandatory law. An unenforceable provision is separated only to the extent necessary, without affecting the remainder. A failure to enforce a right is not a waiver. No non-party may enforce these website terms under the Contracts (Rights of Third Parties) Ordinance (Cap. 623); this does not affect rights available independently of that Ordinance.
